 We don’t keep personal information for longer than is necessary. While we retain this information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

 That said, we advise that no method of electronic transmission or storage is 100% secure and cannot guarantee absolute data security.

 If necessary, we may retain your personal information for our compliance with a legal obligation or to protect your vital interests or the vital interests of another natural person.

 We may collect, hold, use and disclose information for the following purposes and personal information will not be further processed in a manner that is incompatible with these purposes:

 for technical assessment, including to operate and improve our app, associated applications and associated social media platforms;

 to provide you with our app and platform's core features;

 to enable you to access and use our app, associated platforms and associated social media channels;

 to contact and communicate with you;

 for analytics, market research and business development, including to operate and improve our app, associated applications and associated social media platforms;

 for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you;

 and to comply with our legal obligations and resolve any disputes that we may have.

 We may disclose personal information to:

 third party service providers to enable them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights.

 

5. International transfers of personal information

 The personal information we collect is stored and processed in India, or where we or our partners, affiliates and third-party providers maintain facilities. By providing us with your personal information, you consent to the disclosure to these third parties.

 We will ensure that any transfer of personal information from countries in the European Economic Area (EEA) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means.

 Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction. There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

 

6. Your rights and controlling your personal information

 Choice and consent:

 By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with this privacy policy.

If you are under 16 years of age, you must have and warrant to the extent permitted by law to us, that you have your parent or legal guardian’s permission to access and use the app and they (your parents or guardian) have consented to you providing us with your personal information.

 

You do not have to provide personal information to us, however, if you do not, it may affect your use of our app or the products and/or services offered on or through it.

 

Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this privacy policy.

If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

 

Restrict:

You may choose to restrict the collection or use of your personal information. You may request that we erase the personal information we hold about you at any time. You may also request that we transfer this personal information to another third party.

 

Correction:

 If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the email address given below.

 We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

 Notification of data breaches: We will comply with laws applicable to us in respect of any data breach.

 Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach.

We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint.

  Cookies

 Our privacy policy covers the use of cookies between your device and our servers.

 A cookie is a small piece of data that an app may store on your device, typically containing a unique identifier that allows the app servers to recognize your device when you use the app; information about your account, session and/or device; additional data that serves the purpose of the cookie, and any self-maintenance information about the cookie itself.

 We use cookies to give your device access to core features of our app, to track app usage and performance on your device, to tailor your experience of our app based on your preferences, and to serve advertising to your device. 

Any communication of cookie data between your device and our servers occurs within a secure environment.

 

8. Business transfers

 If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data among the assets transferred to any parties who acquire us.

  You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information according to this policy.

 

9. Limits of our policy

 Our app may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites, and cannot accept responsibility or liability for their respective privacy practices.

 For example the app does use third-party services that may collect information used to identify you and by using the app you consent to fully accept and abide with their policies.

10. Changes to this policy

 At our discretion, we may change our privacy policy to reflect current acceptable practices. We will take reasonable steps to let users know about changes via our app or app delivery service.

 

Your continued use of our app after any changes to this policy will be regarded as acceptance of our practices around privacy and personal information.

 If we make a significant change to this privacy policy, for example changing a lawful basis on which we process your personal information, we will ask you to re-consent to the amended privacy policy.

Terms of Service

 

1. Terms

By accessing our app, Odisha Local, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these terms, you are prohibited from using or accessing Odisha Local. The materials contained in Odisha Local are protected by applicable copyright and trademark law.

 

2. Use License

 

a.           Permission is granted to temporarily download one copy of Odisha Local per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  •          modify or copy the materials;
  •           use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  •           attempt to decompile or reverse engineer any software contained in Odisha Local;
  •           remove any copyright or other proprietary notations from the materials; or
  •         transfer the materials to another person or "mirror" the materials on any other server.

b.           This license shall automatically terminate if you violate any of these restrictions and may be terminated by LocalWire at any time.

 Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.


3. Disclaimer

a.           The materials within Odisha Local are provided on an 'as is' basis. LocalWire makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b.           Further, LocalWire does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to Odisha Local.

 

4. Limitations

 In no event shall LocalWire or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Odisha Local, even if LocalWire or a LocalWire authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.


5. Accuracy of materials

The materials appearing in Odisha Local could include technical, typographical, or photographic errors. LocalWire does not warrant that any of the materials on Odisha Local are accurate, complete or current.

 LocalWire may make changes to the materials contained in Odisha Local at any time without notice. However LocalWire does not make any commitment to update the materials.


6. Links

LocalWire has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by LocalWire of the site. Use of any such linked website is at the user's own risk.


7. Modifications

LocalWire may revise these terms of service for its app at any time without notice. By using Odisha Local you are agreeing to be bound by the then current version of these terms of service.


8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Odisha, India and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

User Generated Content Policy

 All content submitted by the user (or on behalf of the user) to the app/website via the User account, including without limitation the user name, biographical information and all other names, usernames, pseudonyms, text, likenesses, graphics, logos, marks, images, photographs, code, and all other information and material shall be called  (UGC) User Generated Content.

 The user shall submit to the app/website in accordance with the following rules (in particular, the Legal Standards and the Review Guidelines, as those terms are defined below).

  The publication of your UGC is at the sole discretion of the app administrators/publisher and the publisher is entitled to make additions or deletions to the UGC prior to publication, after publication and/or to deny publication altogether.

Any UGC submitted to the app/website will be considered non-confidential and non-proprietary.

Use of caution and common sense is recommended while posting UGC through the app/website.

Rights, permissions & waivers

The user hereby grants to Odisha Local (LocalWire) and any of its linked websites/  affiliates a non-exclusive, perpetual, irrevocable, transferable, royalty-free licence (including full rights to sub-license) to use, reproduce and publish your UGC (including, without limitation, the right to adapt, alter, amend or change your UGC) in any media or format (whether known now or invented in the future) throughout the world without restriction.

 

 

The user warrants, represents and undertakes that all UGC the user’s  own work or that the user has obtained all necessary rights and permissions of the relevant owner of the work and that the user has all relevant rights in the UGC to enable you to grant the rights and permissions.

Wherever the UGC contains images of people or names or identifies individuals, you shall warrant, represent and undertake to us as follows:

that all featured or identified individuals are over the age of 18 and have given express consent to their appearance in the UGC and to you submitting the UGC to the app/website, and where featured or identified individuals are under the age of 18, that you are either: the parent or legal guardian of such featured or identified individuals, or have obtained the express consent from a parent or legal guardian of such featured or identified individuals to their appearance in the UGC and to you submitting the UGC to app/website.

The user hereby unconditionally and irrevocably waives and agrees not to assert (or procure the same from any third party where applicable) any and all moral rights and any other similar rights and all right of publicity and privacy in any country in the world in connection with the UGC, to the maximum extent permissible by law.

Content standards – legal standards

The user warrants, represents and undertakes to us that the UGC (including its use, publication and/or exploitation by us) shall not:

   infringe the copyrights or database rights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any other person or entity; and/or

contain any material which is defamatory of any person;

 and/or contain misleading or deceptive statements or omissions or misrepresentation as to your identity (for example, by impersonating another person) or your affiliation with any person or entity;

and/or breach any legal or fiduciary duty owed to a third party, such as a contractual duty or a duty of confidence;

 and/or advocate, promote, or assist discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

and/or contain any malicious code, such as viruses, worms, Trojan horses or other potentially harmful programmes, codes or material; and/or violate any other applicable law, statute, ordinance, rule or regulation, (together, or individually the "Legal Standards").

If the UGC contains any material that is not owned by or licensed to you and/or which is subject to third party rights, you are responsible for obtaining, prior to submission of your UGC, all releases, consents and/or licenses necessary to permit use and exploitation of your UGC by us without additional compensation. Please check clause 2 above for further details.

 

 

 Content standards – review guidelines

 The user warrants, represents and undertakes to the publisher company that their UGC:

is accurate, where it states facts; and/or is genuinely held, where it states opinions (for example, in product or services reviews).

You further warrant, represent and undertake to us that your UGC (including its use, publication and/or exploitation by us) shall be compliant with the User Generated Content policy.

 Any UCG which is obscene, hateful, inflammatory, offensive or in any other way falls below commonly accepted standards of taste and decency in India;

 and/or is reasonably likely to harass, upset, embarrass or alarm a person (including, by way of example only, so called "trolling" or cyber-bullying);

 and/or is threatening, abusive or invades another's privacy, or causes annoyance, inconvenience or anxiety;

 and/or is sexually explicit;

 and/or advocates, promotes, assists or depicts violence;

 and/or advocates, promotes or assists any illegal activity or unlawful act or omission;

 and/or could be deemed to be unsolicited or unauthorized advertising, promotional material, junk mail, or spam (including without limitation chain letters, pyramid schemes or other forms of solicitation or advertisements, commercial or otherwise);

  and/or gives the impression that it emanates from Odisha Local or is endorsed or connected with us, if this is not the case,

will be removed from the Site.

 

 Consequences of breach of policy

 

 The company shall determine, at their discretion, whether the user has failed to comply with this UGC Policy when submitting UGC to the app/website. If the user has failed to comply, the company reserves the right, at their sole discretion, to suspend the user from using the app/website without notice to you and/or to edit or remove (in whole or part) any of your UGC from the app/website on a temporary or permanent basis.

 

 If the user or UGC does not comply with this UGC Policy, and as a result of this, Odisha Local suffers any loss or damage, the said user will be liable to Odisha Local and hereby agree to indemnify Odisha Local for any such loss or damage, as deemed appropriate by Odisha Local. This means that the user will be responsible for any loss or damage the company suffers as a result of the user’s failure to comply with this UGC Policy, including but not limited to our Legal Standards.

 

    The app publisher company reserves the right:

 to pass on any UGC that gives them concern to the relevant authorities; and to disclose the user identity to any third party (or their professional advisor) who claims that any of the user UGC constitutes a violation of their intellectual property rights, or of their right to privacy.

 

 Changes to this UGC Policy

 

The UGC Policy may be changed by the company from time to time, in which case an up-to-date version will be available on the app/website.

 

The user must check this UGC Policy regularly to ensure that he/she is happy with any changes.

 

The user will be deemed to have accepted any changes to the UGC Policy after the user has been notified of the changes on the app/website and/or if the user continues to access or use the app/website, where the updated UGC Policy will be available for viewing.
